Union seeks court order to stop Pontiac prisoner transfer

PONTIAC -- A request for a temporary restraining order will be heard Wednesday as Pontiac prison workers prepare to move 100 inmates within the next two weeks.

Anders Lindall, spokesman for the American Federation of State, County and Municipal Employees, said the hearing was scheduled for 1 p.m. It was unclear in which court the request would be heard, although Lindall earlier said the request would be made in Livingston County.

The union was notified Friday by the Illinois Department of Corrections that it planned to move 50 inmates in the medium-security unit to a minimum-security prison in East Moline. Fifty more inmates are set to be transferred from the medium-security unit to another minimum-security facility in Taylorville next week.

“It looks like the beginning of a closure plan,” Lindall said. “To do this is a sneaky, suspicious way ... we are going to be taking additional legal action.”

Inmate transfers are not unusual within IDOC, but Lindall said they are not usually done in this large of a volume.

IDOC spokesman Derek Schnapp said that the department is unable to comment on the specifics of transfers.

“It is not uncommon for inmates to be moved,” Schnapp said. “We will continue to move inmates when necessary and place them at an appropriate security level.

“We never disclose when and where inmates are being moved because of security reasons,” he said. “But once again, we will continue to move inmates as we deem necessary.”

Schnapp said that it is still the plan of IDOC to close Pontiac Correctional Center by early 2009, and said that now is the time to apply for Thomson positions as the employee screening process will begin shortly.

Lindall said AFSCME is talking to lawyers to see if the union can file some sort of temporary restraining order to stop the transfers. Lindall said any motion would be filed in Livingston County, and the union expects “to go into court very quickly.”

Gov. Rod Blagojevich announced in May that he plans to close the Pontiac prison and would transfer half of the inmates to a mostly unused facility in Thomson by February. The other half of the inmates would be transferred to various facilities in Illinois. The closure would save up to $4 million a year, but a study showed the local economy would suffer a $54 million loss.

A lawsuit filed in Livingston County Circuit Court in September claimed the closing would be illegal because money already had been budgeted for the 2008-2009 fiscal year. That budget was approved by the General Assembly and signed into law by Blagojevich.

A motion to dismiss the lawsuit claims IDOC can choose not to spend the money in a particular way.

Last month, a state study group recommended against the closure. The group’s role, however, is only advisory.

You are so right guardswife. We too drove up to Thomson on Monday and you bet if we are forced to move. We'll be living and spending in Iowa as well. It makes economic sense for our family. Most Pontiac families say they same. There is no reason for Pontiac to close. It is a viable, efficiently run prison. It will cost far less to update it than to open a new prison (besides Thomson) in 2-4 years because crime has escalated and we need more prisons. There are many prisons in Illinois that need far more repair. Hard economic times add to the crime rate. God help us all!! "

" wake up people, just visited Thompson area last week and yes, it is nice out there. Not much housing to offer for all of the displaced families and the camp grounds , if some of you were planning that, are closing or limited without water through winter. In the local papers as well as the realters offices from that area, they are advertising and accepting applications for the locals to get jobs there. The parking lot at the Thompson prision, fuller than we expected, the day we visited, they were screening for future employees. I pray that they don't shut down this pontiac prison but if I am FORCED to relocate my family, I will be doing most of my spending in the state of IOWA. Just going across the bridge into IOWA, the gas prices alone went from, $3.78 in Illinois to $2.36 per gallon. Big difference. This closure isn't going to be a positive for Illinois, it is going to force our Illinois revenue into the State of Iowa. "

as a taxpayer, i have bent over for prison guards to live a very comfortable life babysitting, complete with fully paid medical care that i don't get, and an even more comfortable retirement life. the state is paying nearly 10 MILLION DOLLARS this year alone in retirement costs for pcc.

and i never knew it was the job of the employer, state, or taxpayers to ensure values in your home or gurantee you a job. be thankful you've got a high paying one, and that for the most part you are guranteed one at thompson or elsewhere. if only we were all so lucky to be guranteed a job when our employer closed shop.

we all want to pay less taxes, and closing pcc is the answer as thompson can be run cheaper. if pcc guards really wanted the prison to stay open, they could easily take small pay and benefit cuts - just like the employees at the mitsubishi plant and many of us have - to make up the difference. but we know that won't happen as they are too spoiled to do it.

I have been in Pontiac for over 12 years and have never seen 100 inmates leave the institution so quickly. A very small portion will choose to retire or just choose a new path in life other than DOC, no matter how unfortunate and unneeded that may be. As far as the required numbers needed to fill the positions, huh!, DOC does not and has not cared about the required staffing levels to safely run a prison for quite some time! That is what mandated overtime is for apparently.

If I were you, I wouldnt bank everything on keeping this job, if or when Pontiac closes, we will have bumping rights over you and quite possibly leave you without a job? Be sure to ask about that at the academy, see if they tell you the truth?

I hope it works out for all of us, new hires for Thomson and those of us already employed!

How is the state going to explain the major influx of foreclosures on homes in the Pontiac area? The housing market is in a very bad shape as it is. I do know this much, there are currently 12 Lieutenent positions posted on the CMS web site for Thomson, 6 Counselor positions, and 9 Food Supervisor positions. I also know that the 100 inmates they are moving out of Pontiac are in D-dorm on the medium security unit, and that they are being moved so contracted electrical work can be done to the dorm. Furthermore, if/when they begin moving inmates out of Pontiac in preperation for closure, they will not start with the medium security unit. That is where the food is cooked and frozen for the entire facility, and where the cell house workers are housed. They are not going to move 1600+ inmates all in one day, or week, or month. A move of this magnitude will take several months to complete. Whoever this Derek Schnapp is obviously is being treated like a mushroom by his superiors. "

I finally got the call and job offer last week, along with 90 other people that were all hired for thomson.( we go to our 6 week training monday) They are testing all of this week in thomson because they say they need at least 120 more guards. I am glad to finally be hired, but at the same time i feel for all of the family's in pontiac that will be affected. I hope that every thing works out for everyone. Keep in mind that carroll county is not that bad of an area. "

" To voice of reason 2. This is part of the process of closing. We are not whing to the fact that they are moving the inmates, we are trying to stop it so our prison doesnt get closed. THey will be moving inmates and making it over crowded some place else and there facility will be understaffed also. "

Our poor excuse for a Governor wants to close the prison. Not help with over crowding. Close as in move your family or look for work else where. This will ruin the town of Pontiac stores and restaurants will close, the correctional officer that do transfer will not be able to sell their houses. But look on the bright side Old Rob will get more people up north to tax the heck out of…. Like I have said before Cook County in the only county in Illinois as far as Rob is concerned. "
