Sex offender receives maximum sentence

PAXTON -- Convicted sex offender Jonathan York, 25, of Elliott has been sent to prison for 14 years.

He was sentenced Monday by Ford County Circuit Judge Steve Pacey. In February, a jury convicted York of criminal sexual abuse stemming from a May 2006 incident involving a 5-year-old girl. York already was on probation for similar offenses, all involving girls younger than 13.

State's Attorney Tony Lee sought the maximum sentence for York because he said evidence showed York would likely be a repeat offender. Lee also said York's sexual offender evaluation report listed him as a pathological liar and someone who has poor behavioral control and ignores the rules of society.

York had been on parole from a four-year sentence involving four counts of criminal sexual abuse while living in Pontiac. He served 20 months in the Logan County Correctional Center before being paroled in February 2003.

York's attorney, John Wright of Bloomington, told Pacey a family history of abuse played a role in York's actions. He asked for York to be placed in "a facility capable of dealing with his mental issues" for a term of seven years.

Pacey said he gave York the maximum sentence "for the protection of the public."

" As a victim of sexual abuse as a child, I can tell you that I for one have had to live with the memories and shame for something that was not my fault my whole life. The person who abused me did not serve a single day in jail even though he abused not only myself, but 3 other children that I know of. This man was reported to the authorities and was offerred "counseling". Even if the perpetrator is not guilty of "kidnap, rape and murder", the effects on their victims are life long. So yes, these sick you-know-whats should be locked up away from ANY child for a very long time! I don't really care whose "child" THEY are. As far as the cost issue, should we then let out other dangerous criminals who we KNOW WILL reoffend? Study after study has shown that child molesters cannot be "cured". I sincerely hope that nobody you care about ever has to go through something like that for you to care about the vicitms. "

" To Jessica" Law: You "protect the children" people just don't get it do you? You have to balance costs and benefits. You cannot absolutely protect anything or anybody, ever! Every person you want to "punish" is somebody's "child" just the same as every person you seek to "help". To help, I may add, whether they want you to or not. Nor is there any deterrence value to equating "fondling" or "bad touching" with kidnap, rape and murder. To do so, you devalue human lives on both sides of the perpetrator/victim equation. Unless you want to pay to endless build, staff, and maintain prisons, you cannot keep screaming for longer and stricter sentences. "

Jessica's Law wrote on Mar 28, 2007 6:00 PM:

" We should all contact the men and women in our state legislature to pass some form of Jessica's Law in Illinois. Ours is one of ony 10 states in the country that does not have some form of this law to enforce stricter punishments for sex offenders and protect our children. I'm glad this man got the maximum sentence possible, but it still is not enough. His victims have already been handed life sentences only because they are small children who could not do a thing to stop him! They will have to carry HIS actions with them for the rest of their lives. This creep, on the other hand, will be out in a few short years to ruin another child's life. "

Oh, and dig deeper still if he is attacked while in system. Sure beats the Hell out of study and treatment. Okie, Ignorance is bliss but bliss sure costs a lot. "

" It's unfortunate that this guy only got 14 years and will spend only 12 in prison. That means that the 5 year old will still be in high school. Her sentence is life. She will always be haunted by the memory of this predator. Too bad part of the sentence for child sex offenders isn't castration and a labotomy. "

" They say our children are out future...then protect them in the laws...and make sure they are protected so they can grow up without nasty perverts sexually assaulting them. If they are convicted of sexual assault for a child under 13, they should never see freedom again. how many times we have to see in the news of people molesting a child..and its the second or third time, it makes me sick to think about it. "

Leland Lesher wrote on Mar 28, 2007 7:46 AM:

" When are the Courts and ultimately the Legislature going to learn, realize and act on the fact that pedophiles are all repeat offenders? Those that sexually assault a child the first time are repeat offenders in waiting and will repeat. I agree with "ok", why only 14 years, out in 7 or less, and there will be repeat offense(s) when he gets out and it will be more violent than the previous offenses, possibly involving the death of the future victim(s). The only way to stop this "insanity" is to keep them locked up until they die. The Legislature and the Courts are culpable in this. "

A Reader: wrote on Mar 28, 2007 6:19 AM:

" He is likely to become a repeat offender?? Hasn't he already proven that he IS a repeat offender? A drug dealer in Livingston County gets 16 years(todays paper) of a maximum 40 and this guys gets the maximum of 14 years?? What is wrong with our society?? This should be a maximum of LIFE, and he should have been given it...........without parole. "
